If your business turns over less than AED 3 million a year, there’s a good chance you’re paying more attention to corporate tax than you actually need to. Small Business Relief lets qualifying companies skip the tax calculation almost entirely — not just pay a lower rate, but be treated as if they had no taxable income at all. The Ministry of Finance extended it for another three years in 2026, so it’s worth understanding properly rather than assuming it’s a temporary grace period about to disappear.
What it actually does
Electing Small Business Relief means your business is treated as having no taxable income for that tax period — not a reduced rate, not a deduction, but zero taxable income outright. You don’t calculate deductible expenses, you don’t assess most of the more complex corporate tax provisions, and in most cases you don’t owe any corporate tax for the period. It’s as much a compliance simplification as it is a tax saving — a lot of small businesses spend more on accounting to calculate a small tax bill than the relief would have cost them to elect instead.
The AED 3 million line, and why it’s not what people assume
The threshold is based on revenue, not profit. A consultancy earning AED 2.8 million in revenue with AED 2.6 million in costs — leaving just AED 200,000 in actual profit — is still measured against the AED 3 million revenue figure, not the much smaller profit number. This catches people out in both directions: a high-revenue, low-margin business can be disqualified despite barely breaking even, while a lean, highly profitable small business can comfortably qualify.
The bigger trap is that the test is cumulative, not annual. If your revenue exceeds AED 3 million in any tax period since the corporate tax regime began, you’re permanently disqualified from claiming the relief in that period and every period after it — even if revenue later drops well back below the threshold. A business that had one AED 3.5 million year and has since scaled back down to AED 800,000 doesn’t get the relief back. This makes the election decision in your first few tax periods more consequential than it might feel at the time.
Who’s actually eligible
The relief is open to UAE resident taxable persons, which includes independent freelancers as well as incorporated businesses — it isn’t limited to LLCs or freezone entities. Qualifying Free Zone Persons claiming the 0% freezone rate on qualifying income sit under a separate regime and generally aren’t the target audience for this relief, since they already have a 0% outcome through a different mechanism; the two aren’t typically combined for the same income.
One thing the relief doesn’t excuse you from: corporate tax registration itself. You still need a valid Tax Registration Number and still need to file your corporate tax return on time — the election to claim Small Business Relief happens within that return on the EmaraTax portal, not instead of it. Skipping registration because you expect to qualify for relief is a compliance gap, not a shortcut.
The anti-abuse angle worth knowing about
The Federal Tax Authority has an anti-abuse rule specifically aimed at businesses that artificially split into multiple smaller entities to keep each one under the AED 3 million line. If the FTA successfully challenges a fragmented structure as designed primarily to access the relief, it can deny the relief retroactively, and back tax plus penalties become payable. The relief is built for genuinely small, single businesses — not as a structuring tool for a larger operation split into pieces on paper.
What to actually do
If your revenue is comfortably under AED 3 million and has never crossed it, register for corporate tax if you haven’t already, keep clean revenue records to support your eligibility each year, and elect the relief on your return through EmaraTax. If you’re hovering close to the threshold — say between AED 2.5 million and AED 3.2 million — it’s worth tracking revenue monthly rather than waiting for year-end, since crossing AED 3 million even once closes the door on the relief permanently, and knowing early gives you time to plan around it rather than finding out after the fact.
